i’m asking this question again with a few updates in order to make it clearer to people. this is the same question with updates posted below.
i made a purchase on ebay recently and the seller shipped it with delivery confirmation but no insurance. Now, the tracking says the package has been delivered, but i have never received it. after contacting the post office theyve told me it could have been stolen. i feel like it is their fault for not placing the package somewhere to prevent theft(like the lockbox that is conveniently placed by the mailboxes at the apartment) instead, likely they placed it at my door(it would have fit inside the lockbox several times over). after filing a non receipt claim with paypal they ruled in favor of the seller(who did not purchase insurance). on to case number 2. during the summer i sold something on ebay and shipped it with delivery confirm and insurance. the package was lost in shipping and the buyer(expectedly) filed a claim and was awarded full refund. (paypal went ahead and debited my account for me, thanks)
so what gives? does anyone else see something wrong with this picture?
i’m thinking about taking it to small claims court, however the tracking information on the first package lost is invalid now as its been 6 months
anyone have any suggestions?
I don’t expect anything from usps, because no insurance was purchased, i don’t believe they should be held responsible for this. i think its up to the BUYER to ensure the package is delivered. just because they pass the buck to usps or some other carrier doesn’t mean they’re off the hook, and paypal can take my money from me.
i didn’t assume anything. i’m saying if youre sending something you should put insurance on it if you don’t want to lose your money. just as i did in the case my shipment was lost.
no i’m not contradicting myself. i’m using my example as a shipper for my argument that i should have received my money back from paypal, because in that instance i showed proof of shipment and then the usps lost the package.
let me clarify once again:
on the shipment i made i purchased insurance. the package was lost. the buyer got a refund. i filed an insurance claim. i got my money.
on the second shipment(i was the buyer) they did not purchase insurance. the package was lost. i did not get my refund.
finally, if you don’t have a suggestion, just tell me if you understand my logic?
to me, the same thing happened in both cases. the package was lost. the buyer should’ve received refund in both instances.
i got screwed. period.

    Hmmm, it was lost, probably someone in the
    post office stole it. Not all those employees
    are honest. It happened to me once.

    Well, this is a hard one. It is not the sellers fault that USPS did not deliver it the way they should have so, they shouldnt lose out on it. Although, they should have offered you a price for shipping that would also have included insurance in case you wanted them to purchase that too. Take it as a lesson and do not do business on ebay. There are too many people on there who scam. There are good ones but, at the same time there are bad ones.

    It is up to the buyer to purchase insurance on ebay i know due to i am a seller however if the seller does not offer insurance and i was you or anyone out there buying on ebay i would not buy from them now as a seller i do not give anyone the chance not to get insurance i include it in my shipping cost so i dont have to worry about it however i always get emails about why my shipping is higher and alot of people not wanting to pay itwhich i tell them then dont bid on it if you dont like the cost so if you dint pay the seller for insurance and dint email him that you would like the item to be insured and just bill you with the cost then you are dead in the water on this matter

    Can’t tell you what you should do, but I’d go after the guy who sent you the package. I don’t do ebay for this very reason. I just don’t trust it. I don’t sell nor buy on ebay. I had considered it at one time, but then I heard so many cases of people being duped like in your case here.

    You already answered your own question! When you sold something, you purchases insurance. When you purchased something, you did not purchase insurance from the seller.
    No, you should NOT receive your money back. The USPS has PROOF it was delivered. All the proof YOU have is “I never received it”. Who is to actually say you never received it and turned around and sold it OR have it and trying to do a scam.
    I understand completely what you are saying, I just believe YOU do NOT want to hear the truth! You just want someone to agree with you, which is NOT going to happen because NO INSURANCE!
