if you are downloading music with non public license that it is illegal
but if you download music with public license than it will not be illegal in some condition which can be find in license file

It’s still definitely illegal.
The reason programs like Limewire exist is because P2P filesharing isn’t illegal, but the content might be. Though limewire has in their user agreement (I assume) that you should not use it for illegal downloads, people still do and they do nothing to stop it.
So really the only reason it exists is because of a loophole. Though, if I have my facts straight, I believe they’re currently in a huge lawsuit.

It is illegal to download music that is not abandoned by the artist.
That means, if it is still sold, it will be illegal. Although I highly doubt that there are cops waiting outside your door to see whether you put files downloaded from LimeWire onto your iPod…
